Describes the rules you agree to when using our services.

§ 1 General provisions

The following General Terms and Conditions apply to all services provided by JSJ Tiny Life GmbH, hereinafter referred to as "TINY SPACE", to its users. By submitting an offer to conclude a contract, the user accepts the General Terms and Conditions in their current version. If the user negotiates an individual user contract with TINY SPACE, the provisions of this contract shall take precedence. In such a case, the General Terms and Conditions of TINY SPACE shall apply in addition. General terms and conditions of the user that contradict or go beyond these GTC shall not apply without express written confirmation by TINY SPACE. TINY SPACE's offer is aimed at entrepreneurs. An entrepreneur is any natural or legal person or partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding the contract. With regard to the amendment of the General Terms and Conditions, §20 shall also apply.

§ 2 Conclusion of contract

By making an online booking, booking by telephone or filling out a booking form in the business premises of TINY SPACE, the user submits a binding offer to conclude a contract. In this case, the contract is concluded upon acceptance of the offer by TINY SPACE, which can be made in writing or by e-mail. In the case of contracts with a minimum term of more than one year, however, the parties shall comply with the legally required written form. A user has no claim to acceptance of his offer to conclude a contract of use. TINY SPACE may refuse to conclude a contract at any time and without giving reasons. The user warrants that the information provided by him/her at the start of the contract is complete and correct. The user shall immediately correct or complete any incorrect or incomplete information - even if the incompleteness / inaccuracy only occurs during the term of the contract.

§ 3 Services

TINY SPACE offers users the use of Spaces and additional services at several locations during certain opening hours. The prices for the individual services are set out in the specific contract of use. The specific contents of the respective services are set out in Annex 1 - Service description and the respective individual house rules (attached). Together with the contract of use, these annexes represent the complete range of services owed by TINY SPACE in each individual case. The user has no claims beyond the range of services shown in the contract of use and in the annexes with regard to the respective booked service. If the user is granted advantages or benefits beyond the content of the annexes, this is purely a gesture of goodwill on the part of TINY SPACE and in no case leads to a legally secured claim on the part of the user. TINY SPACE is free to grant such advantages and benefits that go beyond the contractual scope of services only to individual users and only temporarily and to cancel them at any time without this giving rise to claims of any kind whatsoever for the user(s) concerned. TINY SPACE can make the granting of services that go beyond the range of services owed dependent on the payment of additional remuneration. A service booked by a user is not transferable to other persons unless TINY SPACE has expressly agreed to a transfer in writing in advance.

§ 4 Additional services

The following applies to the additional options (extras) booked in the contract of use: The extras can be booked on a monthly basis after the minimum booking period has expired and are billed on a monthly basis. In any case, a minimum charge of one month's fee applies, even if the usage contract runs for less than one month. If the user no longer wishes to make use of individual extras after expiry of the minimum booking period but before expiry of the (main) user relationship, he/she must inform TINY SPACE of this with one week's notice to the end of the term. If the user nevertheless continues to use the extras, he/she must continue to pay the usage fee until the return is granted, without this giving rise to a claim for further use. TINY SPACE may also terminate the use of individual or all extras by giving the user one week's notice to the end of the term.

§ 5 Utilization

the user may use the booked rooms, including the inventory therein, as an office or meeting room. Any other use requires the permission of TINY SPACE. Before the start of use, each user shall carry out a brief check. The user shall check whether there is any visible damage or soiling to the room or the equipment. In the event of visible damage or soiling, the user shall notify TINY SPACE in writing to hello@tinyspace.club with photo evidence that there is visible damage. If damage to the office space becomes apparent or occurs during use, this must be reported immediately to a TINY SPACE employee. TINY SPACE also reserves the right to collect damages or compensation for expenses via the deposited means of payment in the event of demonstrable damage or contamination. The compensation is based on the replacement value and/or repair costs. The expense allowance for cleaning is a flat rate of € 20, or more in special cases.

The user is responsible for ensuring the safety of the area used by the user alone. On special occasions, repairs or similar, TINY SPACE reserves the right to cancel a booking at short notice and propose an alternative date.

A TINY SPACE may have to change location. Usually only a few meters. This does not affect the contract of use. If the change of location is unreasonable for the user, the user has the right to a refund. In the event of a refund, all claims shall lapse.

§ 6 Subletting

The user is prohibited from renting out rooms or desks booked by him (under) without the permission of TINY SPACE or otherwise allowing third parties to use them. TINY SPACE may refuse permission for good cause. The user is only entitled to a right of termination if TINY SPACE wrongfully refuses permission. TINY SPACE may make subletting dependent on the payment of a surcharge on the usage fee, which may not exceed 20% of the last usage fee owed. Half of any additional proceeds from the subletting must be transferred to TINY SPACE.

§ 7 Use of the Internet

The following applies to the use of the Internet access provided by TINY SPACE: the user undertakes to respect and comply with all applicable local, national and, if applicable, international laws and guidelines; in particular to comply with German laws, including in data traffic via the operator (TINY SPACE), and to report violations of the law to TINY SPACE at the e-mail address: hello@tinyspace.club. the user is solely responsible for all his/her actions and omissions in the context of Internet use. the user is subject to legal restrictions when retrieving, storing, transmitting, distributing and displaying certain content. These include, in particular, copyright restrictions. Copying, distributing or downloading copyrighted music or films is strictly prohibited. In the event of a culpable breach of this obligation that results in damage to TINY SPACE, the user must compensate TINY SPACE for this damage. In this case, TINY SPACE also reserves the right to terminate any existing framework agreement without notice. the user makes no attempts to gain unauthorized access to the infrastructure by hacking or similar methods. the user confirms that he/she will not use the TINY SPACE services and infrastructure for any of the activities listed below: Use in connection with sweepstakes, MLM (snowball systems), chain letters, spam e-mail, or any other type of unsolicited messages or advertising, defamation, abuse, harassment, stalking, hate speech, threats or other violation of legal provisions (such as protection of privacy, personal rights) of persons or companies inside and outside TINY SPACE, dissemination of immoral, offensive, pornographic or other unlawful materials or data within or via the infrastructure provided by TINY SPACE and dissemination of data containing viruses, Trojans, worms, bots or other malware. Furthermore, the illegal downloading of copyrighted data, activities that are associated with noise, odor or other nuisance and the provision of false identity data are prohibited. In the event of a violation, TINY SPACE may terminate the user relationship without notice if the user repeats the violation or does not end it despite a warning. In the event of a particularly serious violation, a warning is not required.

§ 8 Payment

When booking services for a limited period of up to one month, the respective usage fee is due for payment directly with the booking confirmation by TINY SPACE. If TINY SPACE is not occupied immediately following the booking, the user may extend the booking. A booking is only considered complete once the user has actively locked the door using a code. TINY SPACE is entitled to charge € 2.50 for each 15 minutes that have elapsed if the booking is extended.

When booking services with an indefinite term, with a term of more than one month or with automatic renewal, the usage fee is due for payment in advance on the third working day of each month of the usage period. Decisive for the timeliness of a payment is the receipt of the usage fee on the account of TINY SPACE. If TINY SPACE reminds the user of the payment in the event of late use, TINY SPACE is entitled to a processing fee of EUR 10.00 per individual case. However, the user is free to prove a lower damage. In the event of late payment, TINY SPACE is entitled to refuse the booking of further services by the user (including access to the respective location) until all payments due, including any reminder fees incurred, have been made in full. Payment can be made by credit card or PayPal. In addition, the user can give TINY SPACE a SEPA basic mandate. The direct debit will be collected one day after the invoice date. The period for pre-notification is shortened to 1 day. The user assures to ensure that the account is covered. Costs incurred due to non-payment or chargeback of the direct debit shall be borne by the user, as long as the non-payment or chargeback was not caused by TINY SPACE. If a payment fails due to the user's fault, the user must reimburse TINY SPACE for any additional costs incurred as well as fees for chargebacks.

§ 9 Contract term

For services with a duration of hours or days, the start and end of the contract is determined by the time of use by the user. By way of example, in the case of the "1 hour" service, the start of the contract is the time at which the user has selected a TINY SPACE and the end is the time at which the user vacates the TINY SPACE. The user must vacate the desk or meeting room in good time in any case if connected use has already been agreed with another user. For services with an indefinite term, the information in the usage contract is decisive for the start of the contract. For services with a monthly extension, the start of the contract is the day specified in the usage contract. The end of the contract in the following month is the day before the day that corresponds numerically to the day on which the contract began. If there is no numerically corresponding day in the following month, the end of the contract is the last day of the following month. In this case, the period from the start of the contract to the end is referred to as the "contract month".

§ 10 Termination

Services that are agreed for a specific period of time (e.g. monthly subscriptions or an agreed fixed contract term) cannot be terminated during the fixed term. The right to extraordinary termination without notice remains unaffected by this. After expiry of the fixed term, the termination of the contract term is governed by the provisions in the user contract. Additional services to the contract of use within the meaning of # § 4 with monthly renewal can be terminated after the minimum term with a notice period of 1 week to the end of the respective contract term. Other services with monthly renewal, such as those listed in Appendix 2, can be terminated after the expiry of any agreed minimum term with one month's notice to the end of the contract month. In addition to the statutory grounds for extraordinary termination without notice, TINY SPACE also has the right to terminate a user contract extraordinarily without notice at any time if one of the following conditions is met:

the user does not pay the usage fee due when due;

the user fails to pay the user fee due even after a payment deadline of one week has been set or fails to pay the user fee due in full on two consecutive payment dates or for the second time within six months;

the user seriously or repeatedly violates the provisions of this contract;

the user violates the obligations specified in ## § 8; termination without notice is possible under the conditions specified therein;
